Statutory Paternity Pay

Statutory Paternity Pay is subject to PAYE and National Insurance contributions and can be paid to an employee whose partner is expecting a child. Statutory Paternity Pay can start at any time from the birth of the child until eight weeks after the birth.

It is paid for a maximum of two weeks. An employee can only take paternity leave in order to care for the new baby or support the mother of the baby. ‘Partner’ can also mean a partner of the same sex in a civil partnership. Statutory Paternity Pay is paid at the lesser of £136.78 per week or 90% of average earnings. Statutory Paternity Pay may also be payable to the partner or civil partner of someone who is adopting a child.
